NEW YORK, N.Y. — Harvey Weinstein's two sex crime indictments were consolidated into one trial by a New York judge in a ruling on Wednesday. Weinstein appeared at the court hearing in a wheelchair.
The judge granted the prosecutors' motion to combine a new indictment with the retrial of charges from his 2020 conviction. A state appellate court overturned the conviction last spring.
"Mr. Weinstein is a fighter, and he's here to fight this case, and he's going to fight with every ounce of strength in his body any health issues that he has," said one of Weinstein's attorneys.
His attorneys say they may petition the judge to reconsider the consolidation and have pushed for two separate trials for the cases.
"You know, obviously, Mr. Weinstein is very anxious to put this behind him,” said his attorneys. “He's very optimistic about the trial, and he's very happy with the trial team.
Weinstine’s attorneys expressed their concerns about the judge’s decision.
“Unfortunately, you know, there's motion practice that needs to be done. We're going to be making some very more substantial motions about that, this new charge that's being brought and whether it should be able to be brought at all."
A possible trial date for April 2025 start was discussed but has yet to be decided. A hearing on pretrial motions is set for Jan 29.
Weinstein is being held in a New York prison where he is serving a sentence from a separate conviction in 2022 on sexual assault charges in Los Angeles.
