On Wednesday, a preliminary hearing for Thomas Bracken vs. The City of Muncie was held in the Hamilton County Courthouse. When opening statements began, both parties agreed to transform the preliminary hearing into the final hearing for the case.
Bracken, who is a Ball State Board of Trustees member, is suing the City of Muncie, the Muncie Redevelopment Commission, the Muncie Economic Development Commission and the Common Council of the City of Muncie over funding for the Madjax building in downtown Muncie.

The Common Council of the City of Muncie approved a $4.5-million loan during its Sept. 11 meeting, however, Bracken said he would rather see a park occupy the area.
After seven hours of witness testimony and cross examinations, both parties now have until Dec. 13 to submit their closing statements to Judge Steven Nation. From there, Nation has two to four weeks to review the statements and make a ruling.
