A Ball State student was arrested over the weekend after police say he hit a child in a campus parking lot while driving while intoxicated.
Jaylon Miskel, 22, is preliminarily charged with operating while intoxicated causing serious bodily injury, a Level 6 felony, according to court documents.
Police responded to an overflow lot on the 3000 block of N. Tillotson Ave. Miskel told police he was driving around 20 to 25 mph when the child "just darted into the street," according to court documents.
"Literally, I came around, boom, literally as I'm coming straight down," Miskel told police. "I literally did not see her. She darted into the car...boom."
The child was transported by helicopter to Riley Children's Hospital in Indianapolis. The child sustained a skull fracture that resulted in brain bleeding, according to an affidavit.
Miskel told officers he had been drinking but was not "belligerently drunk." Miskel took a breathalyzer test and had a blood-alcohol level of .212 percent.
Miskel was taken to the Delaware County Jail and has since been released.
