BOISE, Idaho - A southeastern Idaho lawyer who is also a doctor will be allowed to intervene in a legal challenge to the state's so-called fetal pain abortion law in a case that could set national precedent.
Laws that ban abortion after 19 weeks of pregnancy, under the premise that a fetus may feel pain around that stage of development, have been enacted in several states.
Rick Hearn is joining the case as a plaintiff, and he also represents the Pocatello woman making the first challenge to the constitutionality of such a law.
Authorities said Jennie Linn McCormack took abortion drugs to terminate a pregnancy that was more than five months along on Christmas Eve in 2010.
Hearn's motion to intervene was granted Wednesday in U.S. District Court.
