Judge change granted for contest case

Delaware Circuit Court 5 Judge Wayne Lennington said he granted Republican Party Attorney David Brooks' request for a change of judge to preside over the petition for election contest case.

Lennington selected a panel of three judges, from which each attorney can remove one, he said.

He said the panel included Democrats Richard Dailey, Marianne Vorhees and Robert Barnet, Jr.

Both parties have until Friday to agree upon a judge, he said. If they fail to meet the deadline, Lennington will pick from the panel, he said.

The chosen judge will decide whether to dismiss the case entirely or to proceed with the reelection in Precinct 46, where 19 ballots were excluded from the election recount because they lacked the initials of a Republican clerk, Lennington said.
