Student sues BSU's Delta Tau Delta

Court date remains to be set in lawsuit about Fall assault

A Ball State University student has filed a lawsuit against a former student punished for assaulting him and the fraternity house where the incident occurred.

According to the Delaware County Clerk's Office, sophomore Zachary Holsinger filed civil charges Monday against Chad Stickley, 22, two "John Does" and the Ball State chapter of Delta Tau Delta fraternity.

A court date has not been set, but court summons were sent out, according to the clerk's office. Judge Robert Barnet will hold the trial in Delaware Circuit Court Three.

Interfraternity Council officials said the fraternity suspended Stickley for striking Holsinger at a Nov. 11 party. Joel Sheets, Delta Tau Delta president, said in a previous interview Stickley was suspended for "conduct unbecoming of a member of the fraternity."

Holsinger said he was attending a party at the Delta Tau Delta house when several people asked him to leave because they had a problem with one of his friends.

A group of about 10 people led him outside, and Holsinger said he was pushed to the ground. He tried to get up but lost consciousness and woke several hours later, he said. He could not remember where he was, Holsinger said, but he thought it was off the fraternity's property.

Holsinger was taken to Ball Memorial Hospital with facial and head injuries, he said.

Delta Tau Delta was suspended during the police and university investigations, and regained its status after investigations were concluded.
